Pink Pistols file with the U.S. Supreme Court for Silvera v. Lockyer

 

The Pink Pistols have filed an Amicus Brief with the United States Supreme Court supporting Silvera v. Lockyer.  The question presented for review is, “Whether the Second and Fourteenth Amendments to the United States Constitution protect the right of individual persons to keep and bear arms for their personal protection and the protection of their loved ones as well as their nation.”

 

By filing the Amicus Brief, the Pink Pistols have joined the ranks of joined Women Against Gun Control, Second Amendment Sisters, Doctors for Sensible Gun Laws, Jews for the Preservation of Firearm Ownership, and the NRA.  There is no record on the Supreme Court docket of any anti-gun groups filing in opposition.  The group that caused the most surprise by filing is the NRA.  First they attempted to have the case dismissed, and then they threatened to file in opposition to Silvera.

 

If the Supreme Court accepts the case, it will mark the first time in 64 years that they have ruled on the Second Amendment, and could mark a reversal of the Emerson case.  The Supreme Court is expected to announce during the first or second week in October if they will accept the case.

 

Silvera could prove to be one of the most important cases the Supreme Court has heard in decades.  If the State of California (Lockyer is the Attorney General for CA) should win the case, the right of individual self-defense could be jeopardized.  As an extreme example of what could happen if the court rules for a collective rights interpretation of the Second Amendment, people could legally be deprived of the right to keep and bear arms, based on their gender and sexuality.

 

Because the State of California and Mr. Lockyer have chosen not to file a brief in opposition to the Petition filed by the plaintiffs, attorneys working for the Silvera plaintiffs believe there is a greater than 90% chance of the case being heard.
